LAPLACE – During court proceedings in Edgard Tuesday, a St. John Parish grand jury re-indicted Errol Victor Sr. and his wife, Tonya Victor, in connection with the 2008 death of Tonya Victor’s 8-year-old son, M.L. Lloyd III.
St. John District Attorney Tom Daley said the grand jury downgraded the charge against Errol Victor Sr., Lloyd’s stepfather, from first-degree murder to second-degree murder. It also upgraded the charge against Tonya Victor from accessory after the fact to first-degree murder and cruelty to a juvenile to second-degree murder.

Lloyd died April 1, 2008, after he was taken to River Parishes Hospital in LaPlace by Errol Victor, 44, Tonya Victor, 35, and Lloyd’s stepbrother Errol Victor Jr., 25.
According to reports from the Sheriff’s Office, the boy was unresponsive when the family arrived and was later pronounced dead. The family immediately fled the hospital after Lloyd was dropped off.
A coroner’s report indicated Lloyd suffered various bruises all across his body. The report said the bruises did not appear to be fatal, but the records show Lloyd might have been deceased two hours before he was taken to the hospital.
Daley said prosecutors on the case believe Lloyd’s death was a result of excessive whipping with a belt by both Errol and Tonya Victor. Daley said the charges are in accordance with Louisiana’s second-degree murder statute, which includes the act of cruelty upon a juvenile. He said the prosecution does not have to prove intent to kill.
Tonya Victor had been free after posting a $250,000 bond in connection with the previous charges. Daley said when the new indictment was accepted Tuesday, District Court Judge Mary Hotard Becnel issued an arrest warrant and sent her back to parish jail. Tonya Victor’s new bond was set at $1 million. Tonya Victor remains in jail at the Sherman Walker Correctional Facility in LaPlace. Becnel disallowed a 10-percent payment in lieu of the full amount of the bond.
Errol Victor has been behind bars since February, when ad hoc Judge A.J. Kling Jr., who was sitting in for Judge Madeline Jasmine, revoked an earlier bond set at $2 million.
Daley said both Tonya and Errol Victor were charged on the same indictment and will go to trial together. Both are represented by court-appointed attorneys after the couple appointed and dismissed a long line of personal lawyers.
Daley said there are still a series of motions pending in the case against Tonya Victor. He said he hopes to have those motions resolved in October so that a trail date can be set.
Errol Victor’s family, which included 13 children, resided in Reserve prior to Lloyd’s death.
The St. John Office of Community Services took nine of the children, all younger than 18, into custody and placed them with other relatives.

Why would someone drag and beat a dead child and then bring the child to the hospital. The DA is making up this story. The question the DA asked the medical examiner is could this have happen, not that it did. And because people rather believe a lie then the truth, they begin speading that the child was dragged and beaten. Notice the hospital reported the child arrived unresponsive, not DOA (dead on arrival). The coronor first autospy stated that the child did not die from a whipping and then after under the DA influence to revoke a bond that Victor met, (2million dollars) that shocked them out of their mind, like one of the detective stated I quote "what is a black man here doing with that type of money". UMmmm. Anyway, the coronor changed his autospy report over 2 month later to homicide, because DA story could not hold up otherwise. The first Autospy report shows no sign of internal damage, no scarring, tearing, broken bones, internal bleeding. None. The child was in good physical health. so, let see, A child beaten to death with no internal damages, let get real, no broken ribs, internal bleeding, Nothing. Or better yet a child whipped with a belt to death. come on folk. This Child stopping breathing during an asthma espisode, (That the coroner agreed he had a history of) because he was upset (we know the drill), huffing and puffing because he was spanked with a belt because of stealing- can you relate, (I know I can). and may we be reminded the night before the day of his death. ). This child experience a asthma attack. Now tell me, When did spanking a child with a belt become murder, if that is the case, then 90 percent of our parents should be in jail or arrested.. . Why is the media and DA office not telling the public that Mr. Victor was not even home the morning of the incident and came home and found this child in distress, they have the proof of this. This is no more than an attempt to smokescreen the fact of stopping this land developer from a subdivision project that he was working on that was to begin 30 day later, a project that was attempted on every hand to be stopped by the one and only Asst DA Barry Landry, Bank Board Member Judge Sterling Snowdy and the Godfather of Snowdy and Landry's son DA Tom Daley who just stepped down from the Appellant Court that denied Mr. Victor Appeal, after bringing a judge out of retirement to revoke his bond.. This is nothing but a first class Good Ole Boy frame-up. and Mr. Victor is being sent away and have become a casualty of war because he have been in the past a distraction to their level of security that screams ever so loudly once again, that your kind has no place in this ecomony, but to be feed upon, not to be fed. The reason why they arrested Mrs. T. Victor's wife is she did finally tell them that Mr Victor had a no whipping policy, and he never laid one hand on that child, that she is the one who spanked her child, They arrested her but still refused to release him. Why, Why, Why, maybe because Asst Barry Landry submitted the statement in open court that he is the judge, jury and attorney, In other words I run St. John Parish and if anyone in this judicial system want a career, they better do what I say. Yes, maybe thru the talk of the town, Mr. Victor may not have displayed the best of character, but let's admit it we all have things we need to improve when it come down to our personality, but that's not a reason to take his life. Now the DA office is harassing his family by prowling through their backgrounds to prevent them from getting custody of Mr. Victor's children.This is not a murder case, but a case of Mr. Victor civil rights being violated.
